Privacy Policy for Canadian Customers

NAVTEQ is concerned about privacy on the Internet. As such, NAVTEQ provides this notice explaining its online information practices and the choices you can make about the way your information is collected and used on this Site. Furthermore, this Privacy Policy works in conjunction with the Terms of Use but does not modify or supercede these documents.


NAVTEQ Collection and Use of Your Information

In the course of using this Site, NAVTEQ may ask you for your name, e-mail address, postal address, telephone number, fax number and other registration information. NAVTEQ also may collect certain non-personally identifiable information when you visit many of our web pages such as the type of browser you are using, the type of operating system you are using, the domain name of your Internet service provider, aggregate data about the number of visits to the Site and/or aggregate data about the pages visited.


How NAVTEQ Uses the Information

NAVTEQ uses the non-personally identifiable information ("Aggregate Data") to improve the design and content of the Site, as well as for other uses. NAVTEQ may use the Aggregate Data to analyze Site usage as well as create products and services. Also, NAVTEQ may share this Aggregate Data with third-parties. NAVTEQ shall own such Aggregate Data and maintain copies of such as part of its records.


Except as otherwise indicated, NAVTEQ uses the personally identifiable information ("Personal Information") you provide: (a) to fulfill your requests for our products and services and those of our sponsors and business affiliates and to respond to your inquiries about our offerings; (b) to communicate with you and to assist you with any questions you have about an order you have placed for products and services; (c) for internal marketing purposes; (d) to cooperate with government officials or parties in litigation under process of law or regulation, or as otherwise required by law; (e) to protect the security or integrity of the Site; (f) to protect against a threat of safety or destruction of property; and/or (g) to protect against legal liability. NAVTEQ will not use the Personal Information, except as set forth herein, without your permission; provided, however, NAVTEQ shall own all such Personal Information and maintain copies of such as part of its records.


NAVTEQ may use the Personal Information that it collects to offer you other products or services that may be of interest to you. Some third parties related to your transactions may be supplied with your Personal Information and may use your Personal Information for their own marketing purposes or to send you information regarding products and services that may be of interest to you, however, as with NAVTEQ, any parties with access to such Personal Information are required to act in a manner consistent with this Privacy Policy. NAVTEQ also may make its mailing list available to companies carefully screened, whose products and services may interest you. If you do not wish to receive any such information or to allow NAVTEQ the right to use your Personal Information as described in this paragraph, please contact NAVTEQ in the manner identified in the "Opt-Out" section below. The Aggregate Data and Personal Information may be transferred, distributed or sold as part of NAVTEQ or its assets.


How to Contact NAVTEQ to Opt-Out

You may choose not to receive such information and/or to allow NAVTEQ to use your information in the manner described above by simply notifying NAVTEQ directly at www.navteq.com. Please indicate whether you are opting out of email marketing communication only or all marketing communication. If you do not indicate one of the foregoing, we will construe your "opt out" as pertaining to email only. Upon receipt and processing of an "opt out" request, NAVTEQ will, within a commercially reasonable amount of time, remove your information from any future marketing communications.


Security: No Liability

NAVTEQ has implemented security measures to help protect against the risk of loss, misuse and alteration of any information under NAVTEQ' control. NAVTEQ protects your online order information by using Secure Sockets Layer (SSL) technology. SSL encrypts your order information to avoid the decoding of that information by anyone other than NAVTEQ. To check the security of your connection, look at the lower left or right hand corner of your browser window after accessing the server. If you see an unbroken key or a closed lock (depending upon your browser), then SSL is active. Some versions of browsers and some firewalls don't permit communication through secure servers. In that case, you'll be unable to connect to the server so you won't have to worry about mistakenly placing an order through an unsecured connection.


Nevertheless, such security measures may not prevent all loss, misuse or alteration of information on this Site, and NAVTEQ is not responsible for any damages or liabilities relating to any such security failures. Furthermore, this Site contains links to other sites. NAVTEQ is not responsible for nor can NAVTEQ ensure the privacy practices or content of such other sites.


IP Addresses and Cookies

Like other web sites, NAVTEQ uses your IP address to help diagnose problems with NAVTEQ' servers, to administer this Site and for security purposes. "Cookies" are pieces of data sent from a Web server to a Web browser that enable a Web server to identify users that visit a site hosted by that server. NAVTEQ may use Cookies in order to identify you to our site so that NAVTEQ can provide more customized information and services to you. LIMITING COLLECTION

  • For employees of NAVTEQ Canada Inc., the Company generally collects only personal information reasonably required for the purpose of establishing, managing or terminating an employment relationship (including certain agency or contracting relationships) with NAVTEQ Canada Inc.

LIMITING HOLDING, USE AND DISCLOSURE

  • the Company will not hold, use or disclose your personal information except for purposes to which you have consented or as required or permitted by law
  • the Company has adopted the following guidelines for the retention of your personal information: - where the information is being used for marketing, market research or similar purposes, for a maximum of three (3) years following your consent to the use of your information for such purposes, subject to earlier withdrawal of such consent

  • where your personal information is no longer required by the Company, the Company will destroy the information

ACCURACY

  • the Company uses reasonable efforts to ensure that your personal information is as accurate, complete and up-to-date as necessary for the purposes for which such information was collected by the Company, however the Company will primarily rely on you to advise it of any change in your contact information or other information necessary for the Company to perform its obligations to you

SAFEGUARDS

  • the Company has adopted organizational, physical and technological safeguards appropriate to the sensitivity of the information, e.g., limiting access on a "need-to-know" basis, restricted access and passwords, and where appropriate requiring you to provide identification in any communication with the Company about your personal information, to protect your personal information under its control

    Using this means that you accept its terms

  1. INTRODUCTION
    Welcome to the web site ("Site") for NAVTEQ.
  2. ACCESS TO THE SITE.
    By accessing, browsing and/or using the Site, you acknowledge that you have read, understood and agreed to be bound by these terms and conditions of use ("Terms and Conditions of Use"), including the privacy policy ("Privacy Policy") and to comply with all applicable U.S. laws and regulations. In addition, you hereby represent and certify that you are at least eighteen (18) years of age. If you do not or cannot agree to the Terms, please do not use the Site or any of the services offered through the Site. NAVTEQ reserves the right, in its sole discretion, to update, revise, supplement and to otherwise modify these Terms, and to impose new or additional terms and conditions on your use of the Site from time to time. Such updates, revisions, supplements, modifications and additional rules, polices, terms and conditions (collectively referred to in these Terms as "Additional Terms") will be effective immediately and incorporated into these Terms upon notice thereof, which may be given by any reasonable means including by posting to the Site. Your continued viewing or use of the Site following such notice will be deemed to conclusively indicate your acceptance of any and all such Additional Terms.
  3. ACCEPTABLE USE OF THE SITE.
    In order to use the Site, you must obtain access to the World Wide Web directly or through devices that access web-based content and pay any and all service fees associated with such access.

    a) Individual Use.     (c) Framing. You agree not to create any frames at any other web sites pertaining to or using any of the content located at the Site for any purpose, unless specifically authorized by NAVTEQ in writing to do so.

    (d) Security, Cracking and Hacking. You are prohibited from violating or attempting to violate the security of the Site. Accordingly, you agree not to: (i) access data or materials not intended for you; (ii) log into a server or account which you are not authorized to access; (iii) attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; or (iv) attempt to interfere with service to any user, host or network, including without limitation, by means of submitting a virus to the Site, overloading, "flooding", "mailbombing" or "crashing" the Site. Violations of system or network security may result in civil or criminal liability.     (e) You Are Responsible For All of Your Activities and All of The Content You Post or Submit. You represent and warrant that any information and/or material you post or provide to NAVTEQ by means of the Site, including, without limitation, as part of any registration or subscription or to gain access to or use any services offered on the Site ("Submissions"), is truthful, accurate, not misleading, not confidential property of others, not in violation of any other third party's rights and offered in good faith. You agree NOT to use the Site for or in connection with any of the following activities: (i) transmitting or relaying spam, spoofing or otherwise impersonating any person or entity, or falsely stating or otherwise misrepresenting your identity or affiliation in any way; (ii) using the Site for any fraudulent or illegal purpose; (iii) e-mailing, uploading, or otherwise transmitting or using the Site in furtherance of the use, distribution or transmission of any unlawful, harassing, defamatory, tortious, libelous, sexually explicit, obscene, hateful, racially, ethnically or otherwise objectionable material of any kind; and (iv) transmitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, destroy, disrupt or otherwise impair a computer's functionality or the operation of the Site.

Without limiting the foregoing, you may not, and by using the Site you agree not to, use the Site to: (i) transmit or post any Submissions that are copyrighted, unless you are the copyright owner or have obtained the permission of the copyright owner to transmit it; (ii) transmit or post any Submissions that reveal trade secrets, unless you own them or have the permission of the owner to so transmit them; or (iii) transmit or post any Submissions that infringe on any Intellectual Property Rights (as defined below) of others or violates the privacy or rights of publicity of others. Furthermore, unless otherwise expressly provided, you acknowledge and agree that: (a) all Submissions will become property of NAVTEQ; (b) NAVTEQ has the right to publish the Submissions for any type of use including for promotional and advertising purposes, in accordance with the terms set forth in the Privacy Policy, without compensation to you of any kind; (c) any Submissions that you submit to any part of the Site are non-confidential for all purposes; and (d) that if you make any such Submission, you automatically grant, represent and warrant that the owner of such content has expressly granted NAVTEQ a royalty-free, perpetual, irrevocable, world-wide exclusive license to use the Submissions in any manner, media or form now known or hereafter developed. NAVTEQ shall have the right to sublicense its rights through multiple tiers of sublicenses.     Furthermore, no delay or omission by NAVTEQ to exercise any right or any noncompliance on your part with respect to the Terms shall impair any such right or be construed to be a waiver by NAVTEQ. If any provision of the Terms is found by a court of competent jurisdiction to be invalid or unenforceable in whole or in part, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction, provided, however, if such invalid or unenforceable provision may be modified so as to be valid and enforceable as a matter of law, such provision will be deemed to have been modified so as to be valid and enforceable to the maximum extent permitted by law.
  8. CONTRACT ELECTRONICALLY.
    You agree that the Terms, combined with your act of using the Site and/or the services offered on or through the Site have the same legal force and effect as a written contract with your written signature and satisfy any laws that require a writing or signature, including any applicable Statute of Frauds. You further agree that you shall not challenge the validity, enforceability or admissibility of the Terms on the grounds that it was electronically transmitted or authorized. In addition, you acknowledge that you have had the opportunity to print the Terms.

Terms and Conditions of Purchase

End User Terms: Map data product(s) are subject to the End User License Agreement enclosed with the map data product.

Address Changes: Map data product owners are responsible for notifying NAVTEQ North America LLC ("NAVTEQ") of any address changes. Map data product purchases and subscription updates will be sent to the address on the file. In the event that a shipment is returned due to an unregistered change of address, and the customer requests that NAVTEQ reship the map data product to another address, the customer will be liable for applicable shipping and handling charges.

Product Shipments: Map data product owners are responsible for notifying NAVTEQ within 30 days of shipping date if a purchase is not received. NAVTEQ will replace the missing map data product only if notified of non-receipt within 30 days of shipping date. Map data product subscription owners are responsible for notifying NAVTEQ of non-receipt of updates. If a subscriber fails to maintain an accurate mailing address on file, NAVTEQ's obligation to deliver updates ends with the expiration data of the subscription.

Damaged Product Replacements: Request for replacement must be made within 30 days after the shipping date noted on the delivery note. NAVTEQ will replace map data products damaged during shipment from NAVTEQ with the same version of the map data product originally received. No refunds or map area exchanges will be given on damaged map data products. NAVTEQ will not replace map data products damaged due to customer abuse or neglect.

Replacements: NAVTEQ will replace defective map data products purchased direct from NAVTEQ. After the defective map data product is received and tested by NAVTEQ, a replacement map data product of the same version will be sent to you at no charge. If the returned map data product is not defective, a replacement of the same map disc product release and map data product line version will be sent to you at a charge of $25 USD, plus shipping and handling. Requests for replacement must be made within 30 days after the shipping date noted on the delivery note.

Returns and Exchanges: Only unopened map data products purchased direct from NAVTEQ can be returned to NAVTEQ for refund or exchange. No partial refunds will be given on map data product subscriptions.

  • Returns: Your credit card account will be credited for the price of the map data product. If your order included discounted map data product, the refund will be given to the lower-priced Map Data discs. Partial returns of map sets will not be accepted.
  • Exchanges: All exchanges shall be of the same map data product release and map data product line. A shipping and handling fee will be charged to deliver the exchange map data product.

Requesting Replacements, Returns, and Exchanges: Contact NAVTEQ within 30 days after the shipping date noted on the packing slip. Requests for warranty replacements, returns and exchanges made after 30 days will not be honored.

  • Click on the "Order Status" link and enter your original order number and billing zip/postal code. Orders not complying with the 30-day limit will not be allowed to continue.
  • Click on the "returns" link, which will allow you to complete the online returns process within 30 days of the original ship date.

In your neighborhood and around the world, roads, streets and highways are constantly changing. NAVTEQ's regular updates include critical, fresh details about the road network. With a new map update you can know that you have the latest information available for your GPS navigation system, providing you with more-accurate routing and a more enjoyable navigation experience.

We make every effort to provide maps that are an accurate, up-to-date reflection of your world. Our teams of geographic analysts use highly advanced technology to continually collect and verify changes to thousands of the world's roads, providing the map on your device or system is fresh, accurate and highly detailed. If your navigation system map displays a discrepancy, please use our Map Reporter program to notify us.
